Turning Disputes into AssetsTM

About Tenarys Law

Tenarys Law is a City of London disputes boutique advising businesses, construction companies and insurers on significant disputes where the right commercial course is not always obvious.

The firm was built around a simple idea: significant disputes should be assessed properly from the outset, with the legal merits and commercial reality considered together. We help clients decide whether to pursue, defend, settle or walk away, and we have the litigation experience to take matters through when the right course is to proceed.

How we help clients

Businesses do not want litigation for its own sake. They want the dispute resolved, the financial position protected and management time used effectively.

We assess the legal position and commercial reality together, so that a client can decide whether pursuing, defending, settling or discontinuing a dispute is the right use of its resources.

Where a dispute should be fought, we say so. Where it should not, we say that too.

Our model is designed for significant disputes that require experienced, proportionate attention. We aim to combine the depth required for complex work with a structure that remains commercially sensible for the client.

How we approach a dispute

01 We take a position early

Significant cost can be incurred early in a dispute before the merits and commercial position have been properly assessed. We therefore focus on obtaining an informed view at an early stage.

02 We test the evidence, not the narrative

A client’s account is an important starting point, but the key question is what can be proved, what documents exist and what evidence the other side is likely to produce.

03 We value the outcome, not the claim

A claim worth £800,000 against a company with £90,000 of assets is not a claim worth £800,000. Recovery is part of the assessment from the start.

04 We plan for the right route to resolution

Negotiation, mediation, adjudication, litigation and doing nothing are all strategies. We recommend the approach that best fits the client’s objective and revisit it as the matter develops.

05 We keep the client in a position to decide

Clear costs estimates, fixed fees where the work can be defined, and risk sharing structures where they are appropriate to the case. The firm was built without legacy systems, which is what makes proportionate pricing possible on complex work.

Experience that carries a dispute the whole way

An early view is only worth having if the firm giving it can act on it. Tenarys brings genuine litigation depth to every assessment.

High Court and Commercial Court

Matters conducted through the courts where the value or the point of principle justifies it.

Complex commercial and technical disputes

Experience handling substantial commercial disputes, including matters involving technical evidence, construction issues, expert witnesses, financial loss and complex contractual questions.

Alternative dispute resolution

Negotiation, mediation and settlement strategy, used where they produce a better commercial result than proceedings.

Trial-stage preparation

Matters prepared and carried through to trial where they have to be seen through.

Experience on both sides of a dispute

Tenarys Law was founded and is led by Kevin Timms, a commercial disputes solicitor with more than fifteen years’ experience.

He has defended claims brought against businesses, high net worth individuals and insurers, and he has brought claims on behalf of those same clients. Acting for claimants and defendants alike is what makes the firm’s assessments realistic rather than optimistic: we know how each side builds a case, where the pressure points are, and how the other side is likely to think about settlement.

That experience now informs Tenarys’ approach across commercial, construction and insurance disputes. The firm acts for claimants and defendants and is used to assessing matters from both perspectives, including the evidential, financial and strategic issues that can determine the outcome.

Instructions are handled by senior solicitors, supported by counsel and technical and industry experts engaged as the matter requires, so a client gets the specialist input a case needs without carrying the overhead of a large firm.

How we work

Personal

Our clients include directors, finance leads, claims handlers and in-house counsel who carry the matter internally. They need cash flow disruption minimised, the file to progress and the dispute to reach a resolution.

Reliable

Communication, planning and prioritisation, supported by systems designed for disputes work rather than inherited from general practice. Clients know what is happening on their matter and what is happening next.

Commercial

We establish what the client is trying to achieve, and what the opponent’s purpose is in engaging in the dispute, then prepare early enough to make the strongest use of both. Preparing early is what creates the option to settle well.

Speak to us about a dispute

The initial triage is a short structured conversation about the facts, the exposure and the realistic options. There is no charge for it, and it does not commit you to instructing the firm.
