The assessment considers
- The strengths and weaknesses of the position

- The available evidence and any obvious gaps
- The likely value, exposure and prospects of recovery
- Whether further investigation or expert input is needed
- Whether escalation or settlement is commercially justified

The viability report is one possible next step. The initial triage helps Tenarys Law determine whether the report is appropriate or whether the matter requires a different early response, such as urgent correspondence, counsel’s advice, expert input or focused investigation.

The purpose of the initial triage is to help Tenarys Law understand the issue, its urgency and the decision your business needs to make.
It is not a full legal assessment and does not assume that litigation is the right answer. It helps identify whether the matter is suitable for a Commercial Dispute Viability Report or whether another early response would be more appropriate.
Understand the issue
Clarify what has happened, what is being claimed and what outcome the business is trying to achieve
Identify immediate risks
Consider urgent deadlines, evidence preservation, continuing losses and whether action is required now.
Assess the commercial context
Understand the approximate value, likely exposure, business relationship and practical objective.
Identify the right next step
Determine whether the matter may require a viability report, urgent correspondence, negotiation, counsel’s advice, expert input or another response.

When should a business seek an early view?
A business does not need to have reached a final position or assembled a perfect evidence pack before requesting an initial triage. An early view may be useful where:
A significant payment is being withheld
A customer has refused payment, challenged an invoice or linked payment to an alleged failure.
A claim has been made or threatened
The business needs to understand the strength, value and commercial risk of the other party’s position.
Goods, components or equipment have been rejected
There is a dispute over specification, quality, performance, installation or responsibility.
A contract or commercial relationship has broken down
Informal negotiations are no longer progressing and the business is unsure whether to escalate.
The evidence is complex or technical
The dispute may require expert input, technical records or a clearer understanding of causation.
The appropriate response is unclear
Internal views are divided, the financial exposure is material or management needs a clear recommendation before spending more.

Provide a brief outline of the issue, its approximate value and its current stage. There is no need to upload documents at this point.
02. Tenarys Law reviews the information
The outline is reviewed to understand the nature of the dispute, its urgency and whether Tenarys Law may be able to assist.
03. The appropriate next step is identified
Where appropriate, a short call will be arranged with Kevin Timms. The next step may be a viability report or another form of early action.
